Terms and Conditions

1 Scope 

1.1 These Terms and Conditions apply, unless expressly agreed otherwise, between the service provider and the client for reservations of our services via our social media channels and on our website. The contractual partner, hereinafter referred to as the “service provider,” is Luxury Auto Services S.A.S.U, located at Rue de Neptune 4, 94700 Maisons-Alfort, France. 

1.2 By concluding the contract, the customer accepts the stated terms and conditions. The contract language is English. Contracts can only be concluded under these conditions. Differing, conflicting, restrictive, or supplementary terms and conditions and regulations of the customer must be expressly agreed to by the service provider so that they become part of the contract in individual cases. In particular, the seller’s actions in fulfilling the contract do not constitute consent to any conditions that deviate from these terms and conditions. If several contracts are concluded at different times, the version of the terms and conditions valid at the time the contract was concluded by the client and published or posted by us will become part of the contract. 

2 Conclusion of Contract 

2.1 When concluding the contract, the client confirms that they are at least 18 years old and have full legal capacity. By sending a request for our services, the client assures that their information is correct. 

2.2 The presentation of services on the website does not constitute legally binding offers. The presentation merely invites the customer to make a request. The client can send a booking request through the website’s contact form, through Instagram via direct message, through mail, or by phone. In the booking reservation, the client can choose between our services and a category of vehicle we offer or request another specific car. As a result, the service provider gets in contact with the client and could discuss more details meanwhile. During this, the booking request will be processed, and as far as the request will be operable, the service provider will send a conclusion including services, a cost estimation, and a payment request for requests of trips and excursions, convoyage, VIP services, or exclusively concierge services. If a transfer or car at disposal for detailed hours is requested, and the given information is clear, the service provider will respond with a conclusion of the request and payment request. If the reservation of a service should not be accepted by the service provider, the client will be informed as soon as possible via the chosen contact form about the failure of the request. The contract between the service provider and clients is validated when the service provider sends out a booking confirmation, which usually takes place when the service provider receives the payment for a beforehand communicated service request. 

2.3 Any further reservations or requests during ongoing booked services should be communicated directly to the service provider and need to be confirmed by them and not the operating drivers. 

2.4 By booking the service provider, the client agrees to receive the invoice in electronic form as an email per PDF. 

3 Scope of Services 

For the services described in 3.1, 3.2, and 3.3, the client can choose between categories of cars. The service provider can supply a car based on the category and an equivalent. Booking one category, the service provider reserves the right to upgrade the booking, but the booking will never be downgraded. The service provider reserves the right to change the vehicle or driver at any time. The categories are subdivided into: 

  • Business Class Van: Mercedes V-Class/ Mercedes EQV 
  • First Class: Mercedes S-Class/ BMW 7-Series/ Audi A8/ Mercedes EQS 
  • Business Class: Mercedes E-Class/ BMW 5-Series/ Audi A6/ Mercedes EQE 
  • Economic Class: Peugeot 508/ Skoda Superb/ Tesla 3 or Y 

We are not connected in any form to the aforementioned brands. All trademarks and brand names belong to their respective owners. Luxury Auto Services is not sponsored by them and just uses vehicles from these brands to provide its services. 

3.1 Transfers: This service focuses on transfers to or from Paris to or from the airports Charles de Gaulle, Paris-Le Bourget, and Orly or the train stations Gare du Nord, Gare de Lyon, Gare de l’Est, and Gare Montparnasse. One-way transfers to any destination other than those mentioned can be requested on a flat-rate basis for this service. 

3.2 Car at Disposal: Luxury Auto Services offers a personal chauffeur with a car at disposal for individual needs. This service can be booked on an hourly basis or as a flat rate of 3 or 8 hours and is limited to the area of Paris with a kilometer range of 30km per hour. Also, a disposal of more than one day can be arranged upon request. 

3.3 Excursions and Trips: The service provider offers to organize transport, disposal for trips, tickets, and the possibility to book a guide for a range of excursions and trips. This service will be calculated on request and depends on the individual needs of the client and the destination. After a request, the service provider will be able to provide a cost calculation. 

3.4 Conciergerie: The client can choose the concierge service of Luxury Auto Services. This service includes a range of services like business services, travel arrangements, personal services, health and wellness arrangements, leisure activities, or individual requests. While most of these services can be used when booking a car at disposal or transfers, the concierge service as its own category can be booked upon request on a long-term or frequent basis. The service can be fully adjusted to the needs of the customer, and the price will be calculated on request. 

3.5 Convoyage: Luxury Auto Services offers the service of convoyage. The client can book the pickup or transport of a vehicle cross-country in France or cross-border in Europe. As the service provider offers to drive the car to the individual destination itself or can take care and arrange a third-party transport of a car. This service is calculated on request. The cost calculation will include costs of insurance, arrival and departure costs, possibly hotel and meal costs, and a flat rate of fuel and tolls. 

4 Prices and Payment 

4.1 The prices for all our services will be announced or precalculated in advance on request. All listed prices are final prices, including the service of the driver, the car, insurance fuel for the booking of the services including VAT but not additional services like guides, tickets, parking fees, or similar. Tolls are included on previously arranged services but not on spontaneous changes of bookings. Additional costs like this should be paid directly at the place by the client or will be prepaid by the driver and will be charged afterwards to the client. Prices for airport/train station transfers, flat rate, or hourly disposal bookings can be found announced on our website’s service listing. Trips and excursions, VIP transfers as well as prices of convoyage will be adjusted to the request and calculated by request. 

4.2 Waiting times and additional kilometers: Transfers include a total waiting time of 1 hour. The waiting time starts at the moment of the fixed meeting time. If the client decides to change the route or need more time for stops (like stopping for shopping or a restaurant), then the additional time will be calculated on an hourly basis of our car at disposal price listing. Booking a car at disposal in Paris includes 30km per hour. If the client unexpectedly needs more than this due to a longer route to another destination, then the extra cost of this service would be charged at 2€ per kilometer afterwards if the payment took place in advance. 

4.3 Additional costs of inappropriate usage: By booking Luxury Auto Services, the client confirms to leave the vehicle in an appropriate and clean condition and agrees to the no-smoking policy. Luxury Auto Services reserves the right, in case of strong soiling or smoking inside the vehicle, to charge a fee of 200€ for elimination costs. 

4.4 Clients are accountable for any damage they inflict upon the interior and/or exterior of a rented vehicle. They will be invoiced for any necessary repairs to restore the vehicle to its original condition, along with any resulting loss of income for the driver due to the vehicle being out of service. 

4.5 Luxury Auto Services reserves the right to modify the price list at any time without notice. A change of price will not impact ongoing bookings but will apply to the next upcoming reservations. 

5 Payment Terms 

5.1 Upon receiving the payment request after placing the booking request of one of our services, the client will be prompted to transfer the agreed sum before the upcoming service with an aforementioned booking number to the service provider’s bank account FR7616958000014496012403926 via bank transfer. The payment time for prepaid bookings is 2 working days. The service provider reserves the right to cancel the booking request and decline the services if the payment doesn’t arrive within the agreed time and no other agreements took place. For last-minute bookings taking place in less than 48 hours, an express payment method is necessary. 

5.2 Changes of bookings and additional costs that appear unexpectedly and are requested by the client will be invoiced afterwards and need to be paid within 7 working days by the client by bank transfer. 

5.3 Paying on account is exclusively provided for clients with no payment arrears and booking at least 5 times the service of Luxury Auto Services. 

6 Cancellation and Refund Terms 

6.1 To cancel the booked services, the service provider needs to be informed about the cancellation without a form via email. 

6.2 If a booking of a service gets cancelled more than 48 hours before the reservation of the service, no cancellation fees will be charged, and previous payments made by the client for a booking will be refunded. In case of a cancellation between 48-24 hours, 50% of the price of the service will be refunded. Excluded from these regulations are costs that the service provider can’t get refunded by booking for the customer to a third party (hotel reservation, tickets, fees, etc.). Cancellations in less than 24 hours or a no-show will not be refunded. 

6.3 The service provider reserves the right to decline to operate a service under specific conditions, for example in the case of dangerous passengers, criminal activities, drug or alcohol abuse, or similar. 

6.4 Delay or failure of service: Should a delay of a driver occur, which is the case if the driver doesn’t appear at the fixed booking time, then the service provider will promptly inform the Customer about the delay if unable to provide assistance, present an alternative resolution. If no alternative is feasible, the Customer may receive compensation or reimbursement, subject to the understanding that the reimbursed amount and the service provider’s liability will be capped at the originally reserved service amount or, if unspecified, a maximum of 150 Euros. 

7 Liability 

7.1 Regarding the services provided by the service provider, they, their legal representatives, and their agents shall only be liable in cases of intent or gross negligence. In the event of a breach of essential contractual obligations, liability also exists in cases of simple negligence but is limited to foreseeable, contract-typical damages. 

7.2 Essential contractual obligations are those obligations that the contract imposes on the service provider according to its content to achieve the purpose of the contract, the fulfillment of which enables the proper performance of the contract and on which the participant can regularly rely. Claims for damages resulting from injury to life, body, or health remain unaffected by the above limitations. 

7.3 The client’s belongings are transported entirely at their own risk, and the service provider will not be held accountable for any loss or damage to such property. Luxury Auto Services will hold all found items without responsibility in storage and remark the date of the found. The client has the possibility to contact the service provider in case of a loss and request one of their personal lost items. 

7.4 The availability of the website is ensured to the best of our knowledge and belief. However, the service provider does not guarantee uninterrupted availability of the website. Specifically, no liability is assumed for downtimes, maintenance work, or technical disruptions. The user acknowledges that the use of the website is at their own risk and that the provider is not liable for any resulting damages or losses. 

8 Personal Data and Changes 

8.1 The personal data provided by the customer during the business relationship via email, such as name, address, email, telephone number, and bank details, will be stored and processed by us for the purpose of proper bookkeeping and to prepare the purchase contract and execute the order within the framework of legal authorization. For further information regarding data protection, please refer to our privacy policy. 

8.2 The customer is obligated to promptly inform us of any changes to their residential or business address as well as contact details during the ongoing business relationship. If the customer fails to provide this notification, statements will be considered received even if they are sent to the last address provided by the customer. 

9 Changes and Validity of these Terms and Conditions 

9.1 The seller reserves the right to continuously adjust and update these terms and conditions. Changes will be dated to indicate when the new version of the terms and conditions becomes effective. For contracts already concluded, the version of the terms and conditions valid at the time of contract conclusion shall be part of the contract. It is the responsibility of the buyer to check for updates to these terms and conditions when entering new contracts. 

9.2 If individual provisions of these terms and conditions become invalid in whole or in part, this shall not affect the validity of the remaining provisions and contracts concluded on the basis thereof. If provisions are invalid, the content shall be determined by the statutory regulations. 

10 Applicable Laws 

The General Terms and any related contracts shall be exclusively executed in accordance with French law. Should any discrepancy or conflict arise between the English and French versions of the General Terms, the French version shall take precedence. The English version is provided for informational purposes only. In case of a dispute, the Customer shall contact Luxury Auto Services to seek an amicable resolution of their claim. For any dispute arising from or in connection with this contract, the competent court shall be that of Créteil. For consumers, the competent court is generally the consumer’s place of residence, in accordance with French or European legislation.
